VISUAL CONTENT - TERMS OF USE

“LNDR” means Frank Industries Pty Ltd t/a LNDR, on whose behalf the content is being collected. “The Submitter” means the individual submitting any User Content.

“User Content” means any photos, videos, reels, stories, or other media submitted directly to LNDR, or published on social media and expressly authorised by the Submitter for LNDR to feature. This includes the Submitter’s name, social media handle, and any accompanying caption or text.

These Terms apply to organic channel use only. LNDR’s organic channels are defined as its websites (lndr.com and regional equivalents), its email marketing channel, and its owned organic social media accounts including Instagram, Facebook, TikTok, Pinterest, and YouTube. Use of submitted content in paid advertising, paid media placements, or commercial partnerships will be subject to a separate written agreement negotiated directly with the Submitter.

By submitting User Content, the Submitter grants LNDR a non-exclusive, worldwide licence to use, display, reproduce, and share that content across LNDR’s organic channels. This licence is granted in consideration of compensation provided by LNDR in the form of a gift card, the value of which will be confirmed at the time of submission. This licence remains in effect until withdrawn in accordance with these Terms. LNDR may include the Submitter’s name or social media handle alongside featured content but is not obliged to do so.

LNDR will not use submitted content in paid advertising, paid social placements, sponsored posts, out-of-home advertising, or any paid media format without entering into a separate agreement with the Submitter. LNDR will not sell User Content to unaffiliated third parties for their own commercial use, nor alter submitted content in a way that misrepresents the Submitter or changes its original meaning.

By submitting User Content, the Submitter confirms that the content is owned by the Submitter or the Submitter holds all necessary rights and permissions to submit it; that any individuals appearing in the content have given their consent to be featured; that the content does not infringe any third party’s copyright, trademark, privacy, or other rights; and that the content does not contain unlawful, harmful, misleading, or offensive material. The Submitter is solely responsible for the content submitted. LNDR assumes no liability for User Content.

LNDR reserves the right to decline to feature, remove, or moderate any User Content at its discretion and without notice. LNDR has no obligation to review all content submitted.

Requests to remove User Content from LNDR’s channels should be directed to theexperts@lndr.com. Reasonable removal requests will be actioned within 14 days. Where content has been shared publicly or redistributed beyond LNDR’s direct control, complete removal cannot be guaranteed.

Personal information processed in connection with User Content — including name, image, and social media handle — is handled in accordance with LNDR’s Privacy Policy, available at lndr.com/privacy. Submitters based in Australia, the United Kingdom, or the European Economic Area have the right to access, correct, or request deletion of their personal data by contacting theexperts@lndr.com.

The Submitter agrees to indemnify and hold LNDR, its directors, and employees harmless from any claims, losses, or costs (including reasonable legal fees) arising from any third-party claim relating to submitted User Content or any breach of the representations made in these Terms.

To the fullest extent permitted by applicable law, LNDR’s liability in connection with User Content is limited to direct losses only. LNDR is not liable for indirect, incidental, or consequential losses arising from the submission of User Content or use of LNDR’s platforms.

Copyright owners who believe content featured on LNDR’s channels infringes their rights should contact theexperts@lndr.com with their contact details, a description of the work in question, and the location of the allegedly infringing content. Valid notices will be investigated and responded to promptly.

Instagram, Facebook, TikTok, YouTube, Pinterest, and other social media platforms are independent services operated by their respective companies and are not affiliated with LNDR. Content submitted via these platforms is also subject to those platforms’ own terms and policies.

These Terms may be updated from time to time. Continued submission of User Content following an update constitutes acceptance of the revised Terms.
